When ordering a commission, everyone is required to follow the Terms of Service (TOS).
Failure to do so will result in the commissioner being blacklisted with a warning sent out to potential vendors.
Any statements are bound to change if discussed with myself, the artist, Inkfy, prior to starting the commission.
The TOS will always be referred to in the case of a dispute.
General Terms
Most Important
The commissioner must be either of legal age or has their legal guardian's permission to purchase the commission. The commissioner must acknowledge the commission as being voluntary.
PayPal and Stripe Only (USD). Please inform the artist which payment platform is preferred. Otherwise, PayPal will be used as the default. Full payment is required before working.
Commissions are for personal use only unless the commissioner has paid for commercial usage. Commercial usage must be discussed by both the artist and the commissioner prior to starting the commission.
The commissioner must provide clear visual references. Text-only commissions are not accepted. Inquiries with poor-quality references will be declined (e.g. low-res., blurry, no definable features, confusing details).
The commissioner is allowed four completed WIPs maximum after the initial payment. If the commissioner is not satisfied after exhausting all possible options, the commission will be fully refunded and cancelled.
Major revisions such as entire outfits, poses, full backgrounds, etc., will require a hourly fee. Minor revisions such as small coloring mistakes, missing accessories, minor bg elements, etc., will be fixed free of charge. Extra fees may be charged depending on the complexity of the commission. Please consider these as a possibility if your commission meets said requirements (check "Prices" for more info).
Commissions are worked on in order of when the inquiry was received AND the commission type. Commission turnaround can range from 2 weeks to 2 months depending on the length of the queue and overall complexity. The order of priority is Rush-->Commerical-->Personal. ETAs are not set until near completion (e.g. "Rendering Phase" on my queue).
Full refunds are only given DURING the commission process (see "Refunds & Chargebacks" below), not after the commission has been completed and sent. The cut-off point to get a full refund is BEFORE the "Rendering Phase" on the queue. Once the commission slot has that label, it is being finalized. The commissioner must contact the artist immediately if they need a refund beforehand.
The commissioner is not allowed to TRACE / EDIT / REPOST / SELL and/or RENDER the artwork in any way not discussed during negotiations. The commissioner also can not REMOVE watermarks and credit.
I have no interest in NFTs (Non-fungible Tokens), any blockchain-related technology, cryptocurrency, AI-generated projects, or any future inventions within those spaces. Do not use my artwork for any of those reasons.
The final product will be delivered as a PNG or compressed ZIP via email. No physical copy of the completed artwork is being processed. The commissioner is only receiving a digital file. I, the artist, will not be held responsible for the loss of any artwork once it has been confirmed to be provided to the commissioner.
I, Inkfy, maintain the rights to the artwork created for commissions. I do not maintain the rights to any characters owned by the commissioner themselves or from any established IPs. Characters & relevant concepts in fanwork belong to their respective owners. All rights reserved.

Commercial Commissions
Commercial usage is when the commissioner is generating ANY type of profit from the completed artwork. The commissioner is buying the rights to use the artwork for their product.
The commissioner must include what the artwork will be used for and any specifications for the project (e.g. height/width requirements, type of project, etc.).
Commercial commissions will be prioritized before personal commissions. These commissions have a higher priority and don't follow the normal waiting time(Rush-->Commercial-->Personal).
The commissioner can not claim ownership of the artwork itself, even with full commercial rights. Meaning, you are claiming yourself as the illustrator of the artwork I created.
Commercial usage includes: account banners, streaming assets, game assets (title screens, CGs, character portraits, etc.), promotional work, designs for stickers or charms, prints, merchandise, Live2D, or anything in which the artwork will be a majority of the presentation.
If the commissioner is planning on making merchandise from my concept design, they would need to purchase the 3x commercial fee. For digital-only goods, the 2x commercial fee is used. If the commission is a mix of both digital AND physical merchandise, the 3x will be used in all cases.
For agencies, businesses, or any product that is used as part of brand (e.g. Vtuber) the 3x commercial rights fee will be used.
For some commercial projects, accommodations can be made with how the artist is credited (e.g. no visible watermark but credit is given in a noticeable description). However, the exclusion of both credit AND watermarks entirely is non-negotiable.
Commissioners can come back and purchase the rights for digital goods or merchandise if they wish to do so. They must contact the artist at [[email protected]] to discuss further details.
The commissioner DOES NOT have the right to use the artwork in any blockchain-related technology including NFTs, cryptocurrency, AI-generation, and any future inventions within those spaces. This also includes the intention to use said artwork as the base for future AI or NFT generation. Failure to abide by this will result in being blacklisted immediately.

Private Commissions
Private commissions are when the artworks will not be posted on any social media accounts with the exception of the artist's portfolio.
Private and commercial commissions will be marked as anonymous, but the commission type will be public on the queue.
The commissioner must confirm their commission as being private within the order form. They do not have to explain why, but the commissioner must clarify their commission status.
If the commissioner chooses to share their commission publicly, I, the artist, have the right to do the same.
I have the right to post these artworks as a part of my portfolio if chosen.
The commissioner can "un-private" a commission in the future at their request by simply telling the artist, but they can NOT reinstate the private status onto a commission. Once the artwork is posted publicly, that's it.
Private commissions do not have the option of being made into speedpaints. All speedpaints are chosen from public commissions only.
If asked, the commission will be delayed until a specific date. Commissions are posted as soon as they are completed. This can be at any time as there is no set schedule other than ETAs near completion. **The artist should be contacted soon as possible to ensure the commission is posted during the correct timeframe. **
If the commissioner does not want anything to be posted online, they must let the artist know so accommodations can be made.
Speedpaints (Timelapse Videos)
Not every drawing is recorded. Commissions are chosen at random to record as speedpaints.
There is no guarantee that a commission has been recorded after it's accepted. The commissioner MUST pay a fee to ensure one.
To ensure a public timelapse video (which will be available on my YouTube channel) an editing fee of $50 USD is required.
No "private" videos will be recorded. No requests will be accepted to do so at any time in the future.
The commissioner is NOT being provided with any videos to download.
The commissioner WILL NOT be charged if a speedpaint of their commission is created at random.
These videos simply exist to showcase the progress of said artwork for advertisement purposes as well as for the commissioner's personal viewing.
II. Payment
Payment Process
Contacting the artist with questions regarding your quote is non-binding to the commission.
If you're unsure how much your commission would be, please ask before making an inquiry!
PayPal and Stripe Only (USD). Please state which payment platform is preferred. Otherwise, PayPal will be used as the default.
Full payment is required before working. Any rush/extra fees must be paid upfront as well. These will be detailed within an invoice.
An invoice will be sent to the commissioner after all details of the commission have been discussed (e.g. additional fees, correct email, any missing links for refs and/or project details). Work on the commission starts after confirmation of the payment being received and if there is no one else immediately in line on the queue. Otherwise, the commission will have the "Not Started - Paid" status until the slot is reached.
No payments will be accepted before both the commissioner and I, the artist, have met an agreement. The commission must be approved first before any payment is sent. Payments sent before the approval stage will be immediately refunded. The commission will also be cancelled.
There is a three-day grace period for payment to be received. If no payment is received during that timeframe, the commission will be cancelled. Focus will then shift onto next commissioner in line.
If any trouble occurs with sending payments, the artist must be notified within the three-day grace period or else the commission will be cancelled.
Commissions greater than $1000 USD can be paid half upfront/half after the commission is completed. This must be discussed before the invoice is sent with the artist's approval to avoid any confusion. If not, the commissioner is expected to pay the full price upfront.
For partial payments (greater than $1000 USD), the full-res, completed commission file will not be delivered until the remaining payment has been received. To assure that the commission is fully completed, the commissioner will be shown a low-res, watermarked .jpg.
Pricing Information
There are three price tiers. These include personal usage, commercial usage (2.5x), and (3x).
The initial price is for personal use ONLY (meaning that the completed commission will not generate any profit). Personal use is recommended for profile pictures, gifts for friends/family, personal illustrations for OCs, etc. The recipient can not use the artwork for commercial and promotional purposes!
2.5x pricing is for when the artwork is not the bulk of the product. This includes account banners, streaming assets (schedule, loading screen, social media, etc.), game assets (title screens, CGs, sprites, character design, etc.), promotional material (promotional art, visual key for any commercial project), cover art (digital music albums, light novels, CD covers...). These can be used on monetized platforms. Used for primarily digital-only goods.
3x pricing is for when the artwork IS the bulk of the product. This tier is primarily for when the artwork or concept design will be made into merchandise. This includes fully-illustrated covers, body pillows, T-shirts, postcards, stickers, charms, printed media, Live2D, etc. This price will be used for expected high-selling products or big businesses/agencies. Used for both digital and physical merchandise.
The prices listed for each tier are the base prices. If the commission meets any of the requirements for extra fees, that will increase the total payment.
If the price given is above the commissioner's budget, other commission types and simplifying some elements will be used as alternatives to help accommodate it. However, the base price will never be lowered.
All prices are final. No payments will be accepted after the invoice has been sent UNLESS it's to obtain commercial rights OR fix any pricing errors.
Extra Fee Information
The complexity and development time for a commission may result in extra fees.
Quotes are chosen on a case by case basis depending on the complexity of the character and the amount of details provided.
Quotes for extra fees will increase depending on the demand for certain details to be included. If the commissioner wishes to stay under budget, simplified details and different commission types will be recommended. Otherwise, extra fees will not be lowered.
Rush fees, Speedpaints, and complex details such as very long hair, lots of frills, accessories, complex backgrounds, weapons, mascots, additional elements, etc. have a quote provided under each commission sample in the prices or extra fee section.
Please note that even with Portrait BGs, extra fees for complexity still apply. This will be discussed prior to sending an invoice for the commission.
All extra fees are to be paid for upfront. A detailed invoice will be sent to commissioner listing all the fees for their commission when first making their payment.
Please keep in mind that these fees are a possibility if the commission meets the requirements listed above.
All additional extra fees not listed in the TOS will be discussed between the artist and commissioner before any invoices are sent.
Refunds/Chargebacks
Refunds are only possible during the process of the commission. No refund is possible after the final product has been completed and sent to the commissioner.
The cut-off point to get a full refund is BEFORE the "Rendering Phase" on the queue. Once that status is applied to the commissioner's slot, a full refund can not be given as the commission is near-finalized.
In the case of certain circumstances or emergencies (e.g. client disapproval, financial issues, sudden cancellations, etc.) a full refund will be given regardless.
If a chargeback is filed after the commission has been fully completed and sent, the commissioner's right to everything I, the artist, have ever made for them will be retracted. The commissioner will be blacklisted, unable to commission the artist again. A warning will also be sent out to other potential vendors.
If needed be, I, the artist, have every right to file a complaint or report to receive compensation for my work.
III. Commission Process
Commission Turnaround/Work Speed
Each commission is worked on in order of when the inquiry was received AND the commission type. The typical order for priority is Rush-->Commercial-->Personal. Commission turnaround can range from 2 weeks to 5 months.
Please understand that if the queue is long, the commission will take longer to be completed. If the project has time constraints or the commissioner does not want to wait long, it is highly recommended to pay the rush fee.
Depending on the amount of commissions and other factors such as the artist's, health, family, living conditions, and the complexity of the commission it will take time.
Smaller commissions (e.g. Chibis, Headshots, Bustshots) are typically completed before bigger, more complex commissions (e.g. Fullbody, Portraits, Thigh-Ups, Reference Sheets, Sketchbook Pages). Rush and Commercial commissions will also affect this as those take priority. Please keep this in mind when asking for WIPs or updates.
Commissioners are notified of when work on their commission has started via email. Their slot on the queue is then moved to the "Sketching Phase". ETAs are only given when a commission is at the "Rendering Phase" or near completion.
The commission will be a watermarked, digital file (e.g. .png or compressed ZIP) delivered via email. No physical copy of the completed artwork is being sent. I, the artist, will not be held responsible for the loss of any product once it has been confirmed to be provided to the commissioner.
If I, the artist, feel that I can not fulfill your commission for any reason, it will be cancelled with a full refund given to the commissioner.
Slots are limited! If the commissioner can not be contacted for clarification regarding details of the commission, after one month, it will be cancelled. A full refund will be provided to avoid any disputes.
WIPS/Errors/Revisions
WIPs may be requested after receiving payment for the commission.
WIPs will always be heavily watermarked.
WIPs are only given if requested by the commissioner, delays occur with the commission, OR if details need to be clarified for the commission. These will be known as "check-ups". They act as proof of the commission being completed.
WIPs will be posted publicly. The only exceptions to this are private and commercial commissions unless requested otherwise.
The commissioner is allowed four WIPs maximum. I am willing to provide more WIPs if it's found to be necessary, but this is the hard limit for the majority of commissions.
Minor mistakes such as small color changes, missing accessories, minor bg elements, etc., will be fixed free of charge.
Major changes such as entire outfits, poses, full backgrounds, big color changes, etc., will require an hourly revision fee depending on the time it takes for the revision to be made.
After all potential revisions and negotiations have been made, if the commissioner is still not satisfied, the commission will be cancelled with a full refund provided.
The commissioner does not have any rights to WIPs created for their commission during any stage of progress (this includes cancelled projects).
**WIPs are not to be used for any projects involving AI-generation or NFTs. If the commissioner has been proven to use WIPs for these types of projects, it will result in an immediate blacklist and a warning sent out to potential vendors. **
IV. Copyright and Usage Policy
The commissioner is allowed to:
Use the artwork for its intended purpose (commercial or personal usage).
Use the artwork on non-profit websites and social media accounts (e.g. DeviantArt, Twitter, Instagram, etc.).
Use the artwork as wallpaper, profile pics/icons, gifts for friends, etc.
Sell the artwork for digital goods and/or merchandise after paying the fees for commercial usage.
Print the artwork but NOT sell them as prints unless agreed to otherwise after paying the fees for commercial usage.
Claim the rights to their character(s) but not the artwork itself and/or the creation of the artwork itself.
Publicly post the artwork online/offline with proper credit given to the artist, Inkfy (@inkfycreates) through **linking my website, tagging me in posts, and/or being credited untagged. **
I, the artist, am allowed to:
Use the copyrighted artwork to promote myself online (e.g. portfolio with watermark, commission website, etc.).
Publish the artwork in advertisements, self-promotions, publish the work in books, etc.
Create timelapse videos of the artwork unless agreed to otherwise for privacy reasons.
Display the artwork anywhere to my liking (e.g. social media, online profiles, etc.).
Post the artwork wherever I want.
Copyright infringement
The following are considered violations of the agreement:
Reproducing, distributing, tracing, editing, selling, and/or using the copyrighted artwork(s) commercially without my consent (meaning generating profit from the commission in any way without it first being agreed upon).
Taking credit for the creation of the artwork and/or claiming to have made the artwork yourself.
Not receiving proper credit when reposting said artwork (e.g. not linking my website, tagging me in posts, or being properly referenced untagged).
Uploading speedpaints (timelapse videos) of your commission to any alternative accounts or 3rd party websites.
Removing any watermarks/signatures from WIPs or any completed illustrations.
Altering/modifying the artwork without I, the artist's, consent.
Using the completed commission outside of it's intended usage and/or initial purpose (e.g. stating your commission as personal use only, but using it for commercial purposes).
Using any of my illustrations in any blockchain-related technology including NFTs, cryptocurrency, AI-generation or future inventions within those spaces.
If the commissioner breaks the copyright infringement in any way, every right they have to the commission will be retracted. The commissioner will be blacklisted and a warning will be sent out to potential vendors.

Illustration SPECs.
Most, if not all commissions will be approximately A4 size (3508 x 2480 px) in 350 dpi.
In rare cases, smaller commissions such as Headshots/Chibis OR square ratios are approximately 3000 x 3000 px in 350 dpi. The canvas will be extended or cropped depending on the formatting.
Any other specifications can be largely discussed. If there's a particular format needed for your commission, please inform me in advance.
The final illustration will be a watermarked .PNG or compressed ZIP file sent directly to your email.

Extra Fees
Extra character = full price.
Character Designing. Any commission that requires a hefty amount of references to develop a character will now have 50% of the initial commission type added as a "Character Designing Fee".
ETAs by a certain date will be a rush fee of 50% of commission type (due date can be no less than one week).
Speedpaints (timelapse videos - $50 USD) Not every drawing is recorded. Commissions or personal art pieces are chosen at random to record as speedpaints. To ensure a speedpaint, an editing fee is required.
Details such as very long hair, lots of frills, accessories, complex backgrounds, weapons, mascots, additional expressions for reference sheets/character pages and/or objects not already included in the initial commission (range is between ~$20-100+ USD).
Portrait BGs. Please note that extra fees still apply depending on the complexity. This will be discussed prior to sending an invoice for the commission.

Please keep in mind that the Google Form is only active for a limited period of time. My submission period is also currently CLOSED for 2023.

What IS commercial use?"Commercial usage can be simply defined as the intention to use merchandise, tools or an IP (intellectual property) for financial gain. No matter how little the return is, if you are interested in using my artwork to make money for ANY purposes, it would be considered commercial use. No exceptions.Examples of commercial usage would be: social media banners, streaming assets, game assets, merchandise such as prints, stickers, charms, etc., promotional artwork, Vtuber/Live2D assets, etc....•••••••••••••••••••••••••••••••••Q. "What IS NOT considered commercial use?"• Icons/Avatars for non-profit websites (e.g. DeviantArt, Twitter, Instagram, etc.)• Gifts for friends, family, or using the artwork for profile pics• Using the commission as wallpaper• Printing the commission (but NOT selling the commission as prints)• Keeping the commission for your own personal enjoymentBasically, as long as you are not making money from my artwork in ANY way it doesn't not count as commercial usage.•••••••••••••••••••••••••••••••••Q. "Are there any discounts available?"Discounts are only available for Reference Sheet commissions depending on what elements are simplified and/or removed. I do try to make accommodations for certain circumstances (character designing) but that is my hard limit. If you are not satisfied after all possible adjustments have been made, I will most likely decline the commission and refund your money. I don't think it's fair to work on a commission that both parties are not satisfied with.•••••••••••••••••••••••••••••••••Q. "How much would "x" be?"It depends on the complexity of the element in question and how many details I have to draw for it. Use the charting guide under each commission type as a loose guideline for what I will quote. For example, very very simple, small mascots typically won't cost much more than the base $20 USD fee, but more complex commissions in which the mascot takes up the majority of the composition will hit the current cap of $100+ USD. I'd have to see it before making any final judgments though.•••••••••••••••••••••••••••••••••Q. "Do you allow your artwork to be used in any NFTs/Cryptocurrency/AI art generation, etc.?"No. My artwork is not to be used in any blockchain-related technology, including NFTs, cryptocurrency, blockchains, AI art generation or future inventions within the space.
I have no interest or future plans to work with these platforms or anything related to them. If you see my work being misused in this way, please inform me so I can report it.Q.
