Terms of Service


General Terms

  • Any ill/rude behavior will not be tolerated. I have the right to decline and/or cancel your commission if said behavior occurs.

  • PayPal USD only. I start work after I am paid. Commissioners may request a WIP after the initial payment. Any rush/extra fees must be paid upfront as well. These will be detailed within the invoice.

  • I work on a first come, first served basis, but I don't accept every commission. There are special cases in which this is prone to change (listed below). I also don't set ETAs unless you pay a rush fee.

  • To organize the queue, I will finish smaller commissions (e.g. Chibis, Sketches, Headshots) before bigger, more complex commissions (e.g. Fullbodies, Portraits, Thigh-Ups). The more detailed your commission is, the longer it will take to be completed. Please keep this in mind when asking for WIPs or updates.

  • You are limited to 2 commissions slots at a time with no more than 2 characters & 2 macots per artwork. Afterwards, you will be moved to the end of my queue.

  • I have the artistic freedom to draw in my own style. I understand my style will not work for every drawing, but I will do my best to satisfy my client's needs. That being said, please do not ask me to draw in another artist's style. When you commission me, you agree to accepting artwork within my current style.

  • You must provide clear, visual references. They can be from anywhere(e.g. Anime, Games, MMOs, etc.) I do not accept blocks of text.

  • Reposting your commission is acceptable only if I am properly credited. (e.g. linking my carrd, tagging me in posts, or properly being referenced)

When ordering a commission, everyone is required to follow the guidelines below. Failure to do so will result in the commission being cancelled and a warning sent out to potential venders. Please note that any statements below is bound to change if discussed by me, the artist, prior to the commission. By reading and agreeing with the Terms of Service, you are acknowledging the terms for your commission. These will be referred to in the case of a dispute.

"Commercial USE" Commissions

  • "Commercial use" is when you are generating some type of profit from my artwork. When buying a commercial use commission from me, you are also buying the rights to use my artwork for your product.

  • The "Will Draw/Will NOT Draw" section still applies for commercial use as well. (*Note: Sketch Commissions may not be used for commercial use and are thus unavailable on the chart below.)

  • The conditions for commercial use commissions include; Youtube/Twitch/Patreon banners, promotional artwork, game/streaming assets (not emotes), fully-Illustrated covers, merchandise, or anything in which the artwork will be a majority of the presentation.

  • Commercial commissions have higher priority over my normal commissions, meaning that they don't follow the normal waiting time UNLESS an ETA has already been set.

  • There are 2 tiers for commercial usage. These are 2.5x and 3x price range. The initial price is for personal use only. This means that the drawing will not generate any kind of profit and is for personal enjoyment.

  • 2.5x price is for when the artwork is not the bulk of the product. This includes Youtube/Twitch/Patreon banners, streaming/game assets, promotional artwork, CD covers, etc.

  • 3x price is for when the artwork IS the bulk of the product. This includes fully-illustrated covers, merchandise, body pillows, T-shirts, postcards, etc.

  • Live2D commissions are considered commercial use. They have their own separate prices and do not use the 2.5x/3x price range (coming soon).

  • The commissioner MUST include what the artwork will be used for and any specifications for the project (e.g. height/width requirements & intended purpose/usage).

Private Commissions

  • "Private commissions" are cases in which your commission WILL NOT be posted it on my social media accounts(e.g. Twitter, Instagram, etc.).

  • You must state your commission as being private in your order form. You DO NOT have to tell me why (I have no right to that information unless you choose to tell me), but you must clarify your commission status.

  • However, IF the commissioner chooses to post the work publicly, I have the right to do the same.

  • I also have the right to post these works as a part of my public portfolio (ArtStation) if I choose to do so. You will remain ANONYMOUS as the commissioner. This does not mean every commission will be posted, but this is a general warning.

  • If asked, I will delay posting a commission until a specific date. I post my completed commissions as soon as I'm finished. This can be at any time as I do not have a set schedule other than ETAs. Please let me know as soon as possible so I can post your commission at the proper time.

  • If you do not want anything posted online, please inform me so I can make accommodations for you.

WIPS/Errors/Revisions

  • Each commissioner is limited to 4 WIPs max per commission. WIPs are only given if requested by the commissioner OR if I need to clarify elements of your commission.

  • You are not guaranteed WIPs for smaller, less complex, commissions as I finish those relatively quickly. However, if delays occur, WIPs will be sent to verify your commission being completed.

  • WIPs will always have watermarks/signatures.

  • You may request a WIP after you pay for your commission.

  • I will also send WIPs to verify the stages of completion for your commission. These will be known as "check-ups". They act as proof of the commission being completed.

  • The commissioner does not have the rights to any WIPs created by myself for their commission.

  • Minor mistakes such as small color changes, missing accessories, and/or minor bg elements, will be fixed with no charge.

  • Major changes such as entire outfits, poses, full backgrounds, or big color changes will require a revision fee based on the time it takes for the revision to be made.

II.payment

Payment Process

  • Paypal (USD) only.

  • After the details of the commission are discussed, I will send an invoice to the commissioner. I start the commission after I am paid. This is to ensure that I receive compensation for my work.

  • I will not accept any payments before I have approved your commission. Any payments sent before the approval status will be immediately refunded and the commission declined.

  • There is a 3-day grace period for payment to be received. If I am not paid within that time, your commission will be declined and I will move onto the next commissioner.

  • If you have any troubles with sending payments, notify me within that timefame.

  • Any commission over $500 can be paid half upfront and half after the commission is done. This must be discussed before the invoice is sent with my approval to avoid any confusion.

  • For partial payments (over $500 USD), the full-res, completed commission file WILL NOT be sent until the full payment has been received. To assure that the commission is fully completed, the commissioner will be shown a low-res, watermarked .jpg.

Refunds/Chargebacks

  • Refunds are only possible during the process of the commission. Not after the final product is sent to the commissioner.

  • The last possible chance to get a refund is BEFORE the "Clean Up/Rendering" stage on my queue (by that point I'm mostly done with your commission). Please contact me if you need your money back immediately before then!

  • In the case of certain circumstances or emergencies (e.g. client disapproval, financial issues, sudden cancellations, etc.) I will give a full refund regardless.

  • The commissioner does not hold the rights to use any WIPs created from cancelled commissions.

  • If you file a chargeback against me after the commission has been fully completed, your right to everything I have ever made for you will be retracted. You will also be forbidden to commission me ever again.

  • I have every right to file a complaint if necessary to receive compensation for my work. I have the right to the money owed to me for the finished product.

III.Commission Process

  • Check my commission queue (waitlist) to see your commission status. This is updated with my progress.

  • "First come, first served". If my commission queue is long, your commission will take longer to be completed.

  • I notify commissioners of when I start their commission by moving their slot on my queue to the "sketching phase". This is to ensure that the commissioner knows that I've started their commission. Private commissions will be marked as anonymous.

  • I will also send WIPs to verify the stages of completion for your commission. These will be known as "check-ups". They act as proof of the commission being completed. [Limit is 4 max.]

  • To organize the queue, I will finish smaller commissions (e.g. Sketches, Chibis, Bust-Ups) before bigger, more complex commissions (e.g. Fullbodies, Portraits, Thigh-Ups). Commercial/Rush Commissions usually have time constraints. As a result, they will be given a higher priority if present on the queue.

  • Depending on the amount of commissions and other factors such as my health, family, living conditions, and the complexity of your commission it will take time.

  • I usually don't spend more than 2 to 2.5 weeks on a commission but depending on the circumstances above it can take several months.

  • I do not set ETAs unless you pay a rush fee of $30 USD. You may not pay to "rush" your commission after I've accepted it. All prices are set before I accept your commission.

  • Your commission will be sent as a watermarked, digital file (PNG) to your email. In the case of Live2D commissions and emotes, they will be sent as compressed ZIP files.

IV.Copyright and Usage Policy

The commissioner is allowed to:

  • Use the copyrighted artwork for personal use only unless agreed to otherwise.

  • Use the artwork as icons/avatars for non-profit websites (DeviantArt, Twitter, Instagram, etc.)

  • Use the artwork as wallpaper

  • Print the artwork but NOT sell them as physical/digital prints

  • Decorate their profile(s)

  • Claim the right of their character(s) but not the artwork itself

  • Publicly post the artwork online/offline with proper credit given to the artist, Inkfy, as mentioned in the general terms

I, the artist, am allowed to:

  • Hold every right to the copyrighted artwork, but not the character(s) themselves

  • Use the copyrighted artwork to promote myself online

  • Create timelapses videos of said artwork unless agreed to otherwise for privacy reasons

  • Publish the artwork in books, advertisements, promotions, etc.

  • Display the artwork anywhere to my liking (Social media, online profiles, samples, etc.)

  • Post the artwork wherever I want (*check the "Private Commissions" section for more information)

Copyright infringement

  • The following is a violation of my copyright infringement:

  • Reproducing, distributing, tracing, editing, selling, and/or using the copyrighted artwork commercially without first agreeing to it with myself, the artist (meaning a profit from it in any way without it first being agreed upon)

  • Taking credit for the creation of the artwork

  • Not receiving proper credit when reposting said artwork (e.g. linking my carrd, tagging me in posts, or being properly referenced untagged).

  • Uploading speedpaints (timelapse videos) of your commission to any alternative accounts or 3rd party websites (downloading them to keep for yourself is fine)

  • Removing any watermarks/signatures from my WIPs/finalized artworks

  • Altering/modifying the artwork without I, the artist´s, consent

  • Using the completed commission outside of it's intended usage and/or initial project (e.g. stating your commission as personal use only, but then using it for commercial purposes)

  • If you break the copyright infringement in any way, every right you had to the drawing will be retracted and you will be forbidden to commission me again. A warning will also be sent out to others.

Extra Fees For:

  • Commercial Usage (pricing chart below)

  • ETAs by a certain date (rush commission fee of $30 USD)

  • More than one character (2 characters = 2 orders)

  • Lots of details such as very long hair, accessories, complex backgrounds/weapons/additional mascots, additional expressions for reference sheets and/or objects not already included in the initial commission. (Range is usually between ~$10-40 USD.)

  • Speedpaints (timelapse videos) - I do not record every drawing I make. If you want to ensure that I make one for your commission, you will have to pay an extra fee.

  • These fees will be determined by a case by case basis. I will provide a quote with all additional fees included before asking for payment. Please consider these fees as a possibility if your commission meets the requirements for being more complex.

My ARTIST FAQ (Art supplies/Technical Info, ADVICE, and MY Personal Experiences)

When will your commissions be open again?

I open my commission periodically throughout the year. I don't have any specific dates, but I'll make announcements on my social media profiles for when I'll open again. I'm currently aiming for the period of May 2021.

Do you have a waiting list/Where is the waiting list?

I do have a waiting list! You can find it on my trello. You can be added at any time and the rules are listed there! Just contact me via email [[email protected]] or DM me at @inkfycreates and I'll add you! Please be aware that you will have to follow any updates made to my commission status (these include raised prices, changes to my TOS/general terms, etc.) so be warned!

Do I have to pay to be on the waiting list?

No. Payment is only needed once I start your commission.

Do I have to pay for a private commission?

No. Private commissions themselves do not have any additional fees.

I want a speedpaint of my commission!/Do I have to pay for a speedpaint?

Yes. If you want to ensure I make a speedpaint for your commission, you will have to pay a fee. I don't record every drawing I make. If you don't care whether or not I make one, just mark it on the form! I will NOT charge you in the case that I make a speedpaint from your work, but you initially mark "No" on the form.

What is NOT considered commercial use?

Icons/Avatars for non-profit websites (DeviantArt, Twitter, Instagram), using the commission as wallpaper, printing the commission (but NOT selling the commission as prints), decorating your profile, emotes, and/or keeping it for your enjoyment is NOT considered commercial use. All of these would fall under the personal use category.

Do Live2D commissions count as commercial use?

Yes. Live2D commissions count as commercial use. However, they have their own separate prices depending on the commission type (coming soon). Live2D commissions do not use the 2.5/3x pricing ranges.

What am I getting with a "Reference Sheet" commission?

You are getting for the base price:

What am I getting with a Live2D commission?

You are getting the v-tuber model artwork prepped and ready to be rigged in Live 2D. This includes a PNG file of the model illustration and a ready to rig .PSD file. You are NOT getting a fully-rigged model.

Are there any discounts available?

Discounts are only available for Live 2D and Reference Sheet commissions. All other commission type prices are final.

How much would "x" mascot be?

It depends on the complexity of your mascot and how many details I have to draw for it. Very very simple, small mascots typically won't cost much (usually is around the base $10 USD fee) but more complex commissions in which the mascot takes up the majority of the composition will hit the maximum $40 USD fee. This can also increase depending on the extra details. I have to see it before making any final comments.
